Delegate Shott moves to amend the bill by striking out the title and substituting therefor a new title, to read as follows:

H. B. 2435 – “A Bill to amend and reenact §4-5-2 of the Code of West Virginia, 1931, as amended; and to amend and reenact §5-3-2 of said code, all relating to the prosecution of state criminal law violations recommended for prosecution by the Commission on Special Investigations; authorizing the Commission on Special Investigations to recommend prosecution of state criminal law violations to the appropriate county prosecutor; requiring the county prosecutor to notify the Commission on Special Investigations within six months of a recommendation for prosecution if he or she chooses not to prosecute the matter; requiring the Commission on Special Investigations to refer a matter recommended for prosecution to the West Virginia Prosecuting Attorneys Institute for appointment of a special prosecutor if the county prosecutor chooses not to prosecute the matter; authorizing the Commission on Special Investigations to refer matters to the Attorney General for prosecution in certain circumstances; authorizing the Attorney General to prosecute criminal cases recommended for prosecution by the Commission on Special Investigations; and authorizing the Attorney General to make presentments to grand juries and prosecute persons indicted by such grand juries in all matters referred to the Attorney General by the Commission on Special Investigations.”
